Orders-in-Council No. 193 and 194 February 1, 1982 and directed the Commission to hold hearings on any Applications received for a Certificate of Public Convenience and Necessity for the construction or operation of a pay-television undertaking under the authority of Order-in-Council No. 193 or the ownership and operation of a system of cable undertaking under the authority of Order-in-Council No. 194: and -. BRITISH COLUMBIA UTILITIES COMMISSION ORDER 2 NUMBER T-26-84 NOW THEREFORE the Commission orders as follows: 1. Certificate of Public Convenience and Necessity No. T-26-84 issue to XL Cable Systems Ltd. covering the ownership and operation of a pay-television undertaking, not including broadcasting or the distribution of broadcast signals, serving the City of Dawson Creek, British Columbia, all as more particularly described in the Application and hearing record, subject to the terms of service described in the Application and the hearing record. 2. Certificate of Public Convenience and Necessity No. T-26-84 issue to XL Cable Systems Ltd. covering the ownership and operation of a system of cable undertaking serving the pay-television undertaking at the City of Dawson Creek, British Columbia, all as more particularly described in the Application and hearing record. 3. XL Cable Systems Ltd. is directed to provide further evidence of its ability to finance the project outlined in their Application. 4. Certificate No. T-26-84 will expire if XL Cable Systems Ltd. has not commenced operation of the said pay-television undertaking by December 31, 1984. 5. A complaint which the Commission finds is related to a matter which may be in contravention of the guidelines for enforcemen~ of the obscenity provisions, Criminal Code of Canada may be referred to the Attorney General for investigation and the Commission may suspend that Certificates until such matter is concluded. 6. No variation or alteration in the Certificates of Public Convenience and Necessity or this Order may be made without the approval of the Commission first obtained.
