PROVINCE OF BRITISH COLUMBIA BRITISH COLUMBIA UTILITIES COMMISSION IN THE MATTER OF the Utilities Commission Act, S.B.C. 1980, c. 60, as amended and IN TH E MATTER OF a July 2, 1987 Application for a Certificate of Public Convenience and Necessity by ICG Liquid Gas Ltd. {UICG to enable the proposed construct ion and operation of a Propane Gas Distribution System serving the Blackcomb Benchlands area of Whistler, B.C. and IN TH E MATTER OF a July 2, 1987 Exe mption by ICG Liquid Gas Ltd. pursuant to Section 103(3) of the Utilities Com mission Act (lithe Act") BEFORE: J.D.V. Newlands, Deputy Chairman; and N. Martin, Com missioner ORDER WHEREAS in its Application ICG Liquid Gas Ltd. ----'---------BaniSH COLU~iBiA UTILITIES COMMISSIO 2 ORDER NUMBER _G_-_5_3_-_8_7_ _ WHEREAS ICG also applied for an Order of the Com mission pursuant to Section 103(3) of the Utilities Commission Act exempting ICG from all provisions of the Utilities Commission Act, other than Part 2; and WHEREAS the Com mission has considered the urgency of the matter in order to enable consttLJction to proceed as soon as possible so as not to impede the timely development of the Blackcomb System; and WH EREAS the Com mission has been advised of impending Applications from other interested parties for the provision of storage and distribution works, but not seeking exemption from the provisions of the Utilities Commission Act, other than Part 2; and WHEREAS the Commission at this time does not intend to restrict further Applications from sti II other interested parties; and WH EREAS Com mission Order No. G-I 02-85 dated November 8, 1985 confirmed the operation of propane gas storage and distribution facilities by ICG Liquid Gas Ltd. ("ICG") serving the Resort Municipality of Whistler south of Fitzsi m mons Creek, (the Whistler System) and granted to ICG conditional exemption, to December 31, 1994 from the application of all or any of the provisions of Part 3 of the Act with the exception of Sections 47, 51 and 53; and WHEREAS one of the conditions in Commission Order No. G-102-85 stated that the number of connected customers or accounts of the Whistler System shall not exceed 35 without the approval of the Com mission; and WHEREAS ICG now request that the afore-noted condition be amended by substituting 45 in place of 35 concerning the connected customers or accounts of the Whistler System; and WH EREAS the Com mission has reviewed all of the afore-noted matters. •. /3

Effective the date of this Order a Certificate of Public Convenience and Necessity is granted to ICG Liquid Gas ltd. to proceed with construction of propane gas storage and distribution facilities required to serve various com mercial and residential developments in the area of the Blackcomb Benchlands, north of Fitzsi m mons Creek, in the Resort Municipality of Whistler, B.C. It is a condit ion of this Order that in the event of the selection of an interested party other than ICG Liquid Gas ltd. (1IICG II ) to provide propane gas service to the Blackcomb Benchlands that such other party shall be required to purchase from ICG the total cost of its construction of the Blackcomb System. 2. In view of other Applications, either impending, or which may be received from other interested parties following a public notice (copy attached), the Com mission, in a future Order, to be issued after October 15, 1987 wi II establish a public hearing to determine the appropriate party to serve the Blackcomb Benchlands area. The matter of Applications for Exemption from the provisions of the Utilities Commission Act, other than Part 2 will also be determined at that time. 3. In respect of the Whistler System the Com mission approves the amendment requested by ICG and as a consequence, the number of connected customers or accounts specified in Order No. G-102-85 is amended from 35 to 45. NOTICE IN THE MATTER OF a Propane Gas Distribution System serving H,e Blackcomb Benchlands --area of Whistler, B.C. APPLICA TIONS Applications have been filed with the Com mission as follows: I. I.C.G. Liquid Gas ltd. to function on an unregulated basis. 2. Inland Natural Gas Co. ltd. to function on a fully-regulated basis. The Com mission, having regard for the public interest, will consider Applications from other parties interested in providing underground propane gas service to the Blackcomb Benchlands area. Such Applications must be filed with the Commission not later than Thursday, October 15, 1987. PUBLIC HEARING After October 15 , 1987 the Com mission will issue an Order establishing a public hearing of all Applications. The hearing wi \I determ ine the appropriate party to serve the Blackcomb Benchlands area, and the matter of Applications for Exemption from the Commission Act, other than Part 2, will also be determined at that time.
