McIntyre, Chairman; J.D.V. Newlands, Deputy Chairman; N. Martin, Commissioner; W.M. Swanson,Q.C., Commissioner; and W.A. Best, Commissioner o R D E R WHEREAS British Columbia Hydro and Power Authority ("B.C. Hydro") applied October 11, 1989 pursuant to the Utilities Commission Act ("the Act") for a Commission Order approving an interim rate increase of 3 percent applicable uniformly to all classes of service, including service charges, demand charges and energy charges; and WHEREAS B.C. Hydro stated that with its present rates it would not be able to generate a normal return on capital or meet the minimum financial standards required by Special Direction 113 to the Commission; and WHEREAS the Commission issued Order No. G-49-89 (lithe Order") approving a 3 percent interim increase over existing rates, effective November 15, 1989, with the interim increase to be subject to refund with interest, calculated at the average prime rate of the principal bank with which B.C. Hydro to file its full Application on or before November 30, 1989, with a public hearing scheduled to commence February 5, 1990; and WHEREAS on November 3, 1989 the Consumers' Association of Canada (B.C. Branch), B.C. Old Age Pensioners' Organization, Council of Senior Citizens' Organizations, Federated Anti-Poverty Groups of B.C., Senior Citizens' Association, and West End Seniors' Network (ltCAC (B.C.) et alit), applied pursuant to Section 114 of the Act for Com mission reconsideration of the Order and the interim increase effective November 15, 1989; and WHEREAS on November 7, 1989, the Council of Forest Industries of British Columbia, the Mining Association of British Columbia and the Electrochemical Users (ltCOFI et alit), applied pursuant to Section 114 of the Act for the Commission to reconsider and rescind the Order; and WHEREAS the Commission having reviewed the Applications of CAC (B.C.) et al and COF! et ai, has reconsidered Order No. G-49-89.
