The Minister of Energy, Mines and Petroleum Resources awarded Vancouver Island Gas Company Ltd. ("Vigas") and Victoria Gas Company (1988) Ltd. ("Victoria Gas") the rights to construct and operate natural gas distribution facilities on Vancouver Island and the Sunshine Coast; and B. On November 30, 1990 Vigas, pursuant to Section 37 of the Utilities Commission Act (lithe Act"), filed an Application for Commission approval of Terms and Conditions of an Interim Operating Agreement to construct, operate and maintain a natural gas distribution facility and to provide natural gas service to: Campbell River Parksville Sechelt ·Comox Port Alberni Lake Cowichan Courtenay Cumberland Ladysmith Crofton Duncan Gibsons Qualicum Beach collectively referred to as ("the Municipalities"); and C. On November 30, 1990 Victoria Gas, pursuant to Section 37 of the Act, filed an Application for Commission approval of Terms and Conditions of an Interim Operating Agreement to construct, operate and maintain a natural gas distribution facility and to provide natural gas service to: Central Saanich Metchosin Colwood North Saanich Sidney View Royal collectively referred to as ("the Municipalities"); and D. On December 4, 1990, the Commission by Order No. G-98-90 set the Applications down for public hearing to commence January 7, 1991 in Victoria, B.C. and advised the participants of a pre-hearing conference for December 12, 1990 in Victoria, B.C.; and E. On December 14, 1990 the Commission by Order No. G-106-90 rescheduled the public hearing to commence January 28, 1991 and required the Applicant to enter immediately into meaningful negotiations with the Municipalities in an effort to reach agreement on the terms and conditions of an Interim Operating Agreement SIXTH FLOOR, 900 HOWE STREET, VANCOUVER, B.C, V6Z 2N3, CANADA, TELEPHONE: (604) 660-4700, TOLL FREE 1-800-663-1385, FACSIMILE: (604) 660-1102

During the public hearing ICG Utilities (British Columbia) Ltd. advised the Commission that Vigas and Victoria Gas had changed their corporate names, effective January 21, 1991, to Centra Gas Victoria Inc. and Centra Gas Vancouver Island Inc., respectively (collectively referred to as "Centra Gas"). G. The public hearing into the Application commenced in Victoria on January 28, and concluded on January 30, 1991. H. The Commission has considered the Application and the evidence addressed hereon all as set forth in the Decision issued concurrently with this Order. NOW THEREFORE the Commission hereby orders Centra Gas as follows: 1. The approved Pro-Forma Interim Municipal Gas Operating Agreement as contained in Section 4.2 of the Commission's Decision, is to be used by Centra Gas and the Municipalities for the purposes of gas distribution in the Centra Gas service area. 2. Centra Gas will comply with the orders and directions incorporated in the Commission's Decision issued concurrently with this Order.
