On March 8, 1991 British Columbia and Hydro Authority (flRc' Hydro fl ) applied to the Commission for approval of a Water Rights Agreement ("the Agreement") dated January 1, 1989 with The Corporation of the City of Nelson ("the City"); and B. The Agreement provides for a reallocation of 265 cubic feet per second of firm water from RC. Hydro's allotment under its Kootenay Canal Water Licence to the City for a period extending to October 1,2005; and C. The Commission has reviewed the Application and finds that approval is necessary and in the public interest. NOW THEREFORE the Commission orders as follows: The Commission approves the January 1, 1989 Water Rights Agreement between RC. Hydro and the City that provides for a reallocation of 265 cubic feet per second of firm water from RC, Hydro's allotment under its Kootenay Canal Water Licence to the City that covers the period January 1, 1989 to October 1,2005.
