Amendments to the Utilities Commission Act ("the Act"), including Section 85.3, require that Energy Supply Contracts ("Contracts") between producers and consumers be fIled with the Commission for approval; and B. On December 17, 1990 British Columbia Hydro and Power Authority ("B.C. Hydro") filed with the Commission a fully executed Contract with Westcoast Energy Inc. ("WEI") and CU Power, a division of Canadian Utilities Limited ("CUL") (collectively referred to as "Wescup") covering the supply of electric power and energy to B.C. Hydro at Taylor, B.C. from the McMahon Cogeneration Project; and C. The Commission has reviewed the Contract including technical requirements and is satisfied that such approval is necessary and in the public interest NOW THEREFORE pursuant to Section 85.3 of the Act, the Commission hereby orders as follows: The Commission accepts for filing the Electricity Purchase Agreement dated April 10, 1990 between B.C. Hydro and Wescup covering the supply of power to B.C. Hydro at Taylor, B.C. which is designated as Energy Supply Contract, ESC No.7.
