Martin, ) July 10, 1991 Commissioner; and ) W.M. Swanson, Q.C., ) Commissioner ) ORDER WHEREAS: A. On February 15, 1991 Inland Natural Gas Marketing Ltd. ("INGM") advised the Commission that B.C. Gas Inc. - Lower Mainland Division ("BC Gas") had overcharged its 23 direct purchase, industrial clients served under Rate Schedule 2007 - Finn Transportation Service; and B. INGM and other industrial customers complained that the amount being overcharged resulted from transportation charges under Rate Schedule 2007, being added to transportation charges which are included as part of the rate for monthly imbalance gas sold under Rate Schedule 2209 - General Service - Industrial; and C. BC Gas advised the Commission that this effective double charging of transportation charges was meant to provide an appropriate incentive to minimize im balance gas use; and D. The Commission has considered the evidence and finds that there should be no double charging of rates for transportation services on the BC Gas system. NOW THEREFORE the Commission Orders as follows: 1. The complaints by INGM on behalf of its clients, Kelfor Industries Ltd., and others concerning a double charging of transportation charges are accepted. 2. BC Gas is to refund any excess charges collected under Rate Schedule 2007 - Finn Transportation Service for imbalance quantities from January 18, 1990, the date upon which the tariff was approved by Order in Council No. 93. 3. BC Gas is to proceed with such refunds and provide the Commission with a reconciliation and computation schedule by August 30, 1991. 4. BC Gas is to refile a revised Rate Schedule 2007 - Finn Transportation Service that will indicate more clearly the charges intended for industrial sales gas.
