Jaccard, ) Chair; and ) November 5, 1992 L.R. Barr, ) Deputy Chair ) CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On October 28, 1992 BC Gas Inc. ("BC Gas"), applied to the Commission for approval of a Standard Form Franchise Agreement ("the Agreement") dated September 4, 1992 with the Village of Cache Creek (lithe Municipality"), pursuant to Section 51 of the Utilities Commission Act (lithe Act"); and B. The Agreement replaces a 21-year gas Franchise Agreement dated October 12, 1971 between Inland Natural Gas Co. Ltd., a predecessor company to BC Gas, and the Municipality that expired September 6, 1992; and C. Municipal By-Law No. 466, 1992 approved the Agreement and received approval in principle from the Minister of Municipal Affairs, Recreation and Culture on September 28, 1992; and D. The Commission has reviewed the BC Gas Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Act, the Commission approves the Agreement between BC Gas and the Village of Cache Creek dated September 4, 1992 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
