IN 1HE MA1 TER OF the Utilities Commission Act, S.B.e. 1980, c. 60, as amended and IN 1HE MA1 TER OF an Application by BC Gas Inc. BEFORE: J.D.V. Newlands, ) Deputy Chainnan; and ) N. Martin, ) June 16, 1992 Commissioner ) o R D E R WHEREAS: A. On June 11, 1992, BC Gas Inc. - Columbia Division ("BC Gas") applied for Commission approval to place the overdue balances owing by Westar Mining Ltd. ("Westar Mining") in a deferral account, the action being necessitated by the financial instability of Westar Mining; and B. BC Gas also requested that all current and future amounts due and owing by Westar plus related legal expenses associated with the matter be set up in a deferral account and amortized against rates of customers which will be determined at a future date; and C. The Commission has reviewed the Application and finds that approval of the BC Gas deferral account related to Westar Mining is necessary and in the public interest. NOW THEREFORE the Commission orders BC Gas as follows: 1. The Westar Mining outstanding account of May 31, 1992 in the amount of $707,875, all future amounts to be due and owing by Westar Mining, plus associated BC Gas legal expenses related to the matter, are to be placed in a deferral account, the disposition of which will be made by future Commission Order. 2. The Westar Mining deferral account is to attract interest at the average prime rate of the principal bank with which BC Gas conducts its business.
