Jaccard, ) Chair ) L.R. Barr, ) December 4, 1992 Deputy Chair; and ) H.J. Page, ) Commissioner ) o R D E R WHEREAS: A. On November 10, 1992, the International Brotherhood of Electrical Workers ("the mEW") applied to the Commission, pursuant to Section 114 of the Utilities Commission Act ("the Act"), for Reconsideration of Order No. 0-95-92 that adopted the Recommendations made in the Sands Report on the BC Oas Furnace Repair Plan; and B. The Application argues that the Commission acted contrary to the Act, in that it did not conduct a hearing pursuant to Section 100; and C. Commission Order No. 0-49-92 appointed Ms. Elsie L. Sands as an Inquiry Officer to review the Plan, under specified terms of reference, and deliver a report and recommendations to the Commission, pursuant to Section 93(2) of the Act; and D. Section 93(2) of the Act does not require the Commission to conduct a public hearing but allows it to act upon a report made by an Inquiry Officer; and E. The Commission has reviewed the filings and concludes that its decision to adopt the recommendations contained in the Sands Report on the BC Oas Furnace Repair Plan is in accordance with the Act NOW THEREFORE the Commission orders that the November 10, 1992 Application by the IBEW for reconsideration of Order No. 0-95-92, pursuant to Section 114 of the Act, is denied.
