Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) November 3, 1994 CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On March 16, 1994 Centra Gas British Columbia Inc. ("Centra Gas") applied to the Commission for approval of a Standard Form Municipal Gas Operating Agreement ("the Agreement") dated February 2, 1994 with The Corporation of the District of Saanich ("the District"), pursuant to Section 51 of the Utilities Commission Act ("the Act"); and B. The Agreement initiates a 3-year Gas Operating Agreement that covers the period January 1, 1994 to December 31, 1996 between Centra Gas and the District and is consistent with the intent of the pro forma Gas Operating Agreement established by Commission Decision and Order No. G-13-91 dated February 8, 1991 and Commission Decision and Order No. G-25-91 dated March 8, 1991; and C. The Commission has reviewed the Agreement and finds that approval is necessary and in the public interest. NOW THEREFORE pursuant to Section 51(4) of the Act, the Commission approves the February 2, 1994 Agreement between Centra Gas and the District covering the period January 1, 1994 to December 31, 1996 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
