BEFORE: M.K. Jaccard, Chairperson; and ) F.C. Leighton, Commissioner ) February 11, 1994 ORDER WHEREAS: A. On November 22, 1993 BC Gas Utility Ltd. ("BCGUL") filed with the Commission an application based on a two-year test period to increase, on an interim and permanent basis, captive rates of customers in the Lower Mainland, Inland and Columbia Divisions effective January 1, 1994 and a further increase effective January 1, 1995 (lithe Application") pursuant to Sections 64 and 101 of the Utilities Commission Act; and B. The Commission by Order No. G-120-93 approved for BCGUL an interim rate increase of 6.26 percent on gross margin revenue of the captive rate schedules effective with consumption on and after January 1, 1994. The Commission also requested submissions from all interested parties before January 5, 1994 with respect to the holding of a separate joint hearing to deal with the rates of return on common equity for both Pacific Northern Gas Ltd. and BCGUL. The matter of a public hearing or the use of an Alternate Dispute Resolution into the Application would be the subject of a further Order of the Commission; and C. The Commission, by Order No. G-130-93, established a provisional hearing date of April 25, 1994 for the commencement of a public hearing into the Application; and D. The Commission, by Order No. G-4-94, set up a separate joint hearing to deal with the rates of return on common equity for certain utilities under its jurisdiction, including BCGUL, that will commence on April 5, 1994; and E. On January 24, 1994 BCGUL provided a response to Commission staff Information Requests and a pre-hearing conference was held on February 4, 1994, with respect to the process and a timetable for the resolution of potential issues. NOW THEREFORE the Commission orders BCGUL as follows: 1. The process to resolve the potential issues (except those relating to return on common equity and capital structure) will follow the attached timetable. 2. Specifically, intervenors and interested parties are to advise the Commission Secretary, in writing, of their intention to participate in the proceedings by Monday, February 28, 1994.

All parties intending to apply for Participant Funding must file a budget by February 28, 1994 consistent with the Commission's Guidelines as outlined in Commission Order No. G-117-93, copies of which are available in BCGUL's offices. 4. Interested parties intending to make requests for additional information from BCGUL should do so as soon as possible, but no later than Monday, March 7, 1994. Information requests shall be responded to by BCGUL by Monday, March 14, 1994. 5. All interested parties who wish to participate as Intervenors shall file any submissions or evidence by Friday, April 8, 1994 with Mr. R.J. Pellatt, Commission Secretary, B.C. Utilities Commission, Sixth Floor, 900 Howe Street, Box 250, Vancouver, B.C., V6Z 2N3. Questions regarding the above should be directed in writing or by telephone to Mr. Pellatt or Mr. Simon Wong (Manager, Rates and Finance, Petroleum) of the Commission at (604) 660-4700, or BC Toll Free 1-800-663-1385. 6. The time and place for the various workshops and Negotiation Dates will be further advised by the Commission to Registered Intervenors. 7. A final Pre-hearing Conference will be held in the Commission Hearing Room at 9:00 a.m. Wednesday. April 20, 1994. 8. A Public Hearing will be held commencing 9:00 a.m. Monday, April 25, 1994 in the Commission Hearing Room. 9. BCGUL will publish, in display-ad format, the attached Notice in the business sections of The Vancouver Sun and The Province newspapers, and in local newspapers in its service area before Monday, February 21, 1994. THE APPLICATION BC Gas Utility Ltd. ( t1 BCGUL tI ) applied to the Commission to increase rates to all customers in the Lower Mainland, Inland and Columbia Divisions effective January 1, 1994 with a further increase effective January 1, 1995. The Commission, by Order No. G-120-93, approved an interim rate increase of 2.47 percent to all captive rate schedules (6.26 percent on gross margin) for 1994. The Commission by Order No. G-130-93 set a provisional hearing date of April 25, 1994. PROCESS As outlined in a timetable contained in Order No. G-1O-94, BCGUL will conduct various workshops (on specific and technical issues) for Intervenors and Interested Parties commencing Thursday, March 3, 1994. Negotiations to clarify or seek resolution of certain issues will occur from March 29 to 31, 1994. Unresolved issues will be examined in the public hearing on April 25, 1994. PRE-HEARING CONFERENCE A Pre-hearing Conference to identify specific issues will be held at 9:00 a.m., Thursday, March 17, 1994 in the Commission's Hearing Room. A final Pre-hearing Conference will be held in the Commission Hearing Room commencing at 9:00 a.m., Wednesday, April 20, 1994 in order to clarify unresolved issues or answer questions of the participants. PUBLIC INSPECTION OF THE APPLICATION The Application, supporting material and Commission Orders No. G-117-93, G-120-93, G-130-93, G-4-94, and G-1O-94 are available for inspection at the following locations: BC Gas Utility Ltd. Head Office: 1111 West Georgia Street, Vancouver, B.C., V6E 4M4. District Offices: Kelowna, Penticton, Kamloops, Prince George and Cranbrook, B.C. An Executive Summary of the Application is available to Interested Parties, upon request from BCGUL at no charge. 2 INTERVENTIONS Intervenors and Interested Parties are to advise the Commission Secretary of their intention to participate in the proceedings, in writing, by Monday, February 28, 1994. INFORMATION REOUESTS Registered Intervenors or Interested Parties requesting additional information from the Applicant should do so as soon as possible, but no later than Monday, March 7, 1994. Information Requests shall be responded to by BCGUL by Monday, March 14, 1994. SUBMISSIONS BY INTERVENORS Written evidence from Intervenors is required to be filed, one copy each, with the Commission Secretary and BCGUL, by Friday, Apri18, 1994.
