Jaccard, Chairperson; ) L.R. Barr, Deputy Chairperson; and ) December 22, 1994 K.L. Hall, Commissioner ) ORDER WHEREAS: A. On November 15, 1994 Trans Mountain Enterprises of British Columbia Limited ("TME") applied to the Commission under Section 44 of the Pipeline Act, R.S.B.C., c. 328 ("the Act") for approval of a 3.5 percent toll reduction for the gathering of jet fuel and its delivery to the Vancouver International Airport using its Jet Fuel Pipeline, effective January 1, 1995 ("the Application"); and B. TME advised the Commission that the 3.5 percent reduction in tolls on the Jet Fuel Pipeline is due to an expected throughput increase of 8.5 percent over 1994 levels and an expected 4.7 percent or $104,000 increased cost of service for 1995; and C. On December 15, 1994 the Vancouver Airport Fuel Facilities Corporation and Canadian Airlines International ("the Airlines") filed a complaint into the Application and requested that TME's 1995 forecasted administrative expenses be reduced from the 1994 level; and D. On December 19, 1994 the Airlines clarified that its complaint was requesting that the Application's 1995 forecast of administrative expenses should reduce the outside services fee by $24,000 to reflect the 1994 approved level. The Airlines confirmed that it accepted the Application's forecasted costs of major capital projects and the variance provision; and
2 P-6-94 E. The Commission has considered the Application, the Airlines' communications and finds that a decision on the Application is in accordance with the requirements of the Act. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for TME and its Jet Fuel Pipeline a 3.5 percent toll reduction, on an interim basis, effective January 1, 1995. 2. All comments on the Application and the Airlines' complaint must be filed with the Commission by January 16, 1995. 3. The Commission advises that its costs in dealing with the complaint may be charged to TME, and those costs, or a portion thereof, may be allowed in the calculation of permanent 1995 tolls.
