Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ORDER WHEREAS: A. On November 13, 1996 West Kootenay Power Ltd. ("WKP") applied to the Commission for approval of a Power Purchase Agreement ("the Agreement") with Bonneville Power Administration ("BPA") for the purchase of firm energy and capacity for the months of November and December 1996, and January and February 1997 for delivery at Cominco Limited's Boundary Substation; and B. WKP states that the purchase of the firm energy and capacity will displace higher-priced supplies available under British Columbia Hydro and Power Authority's Rate Schedule 3808 and from Washington Water Power capacity purchases. No. E-17-95, an Electricity Enabling Agreement between WKP and the Western System Power Pool under which energy and capacity exchanges will occur; and C. The Commission has reviewed the filing and is satisfied that approval of the Agreement is necessary and in the public interest. NOW THEREFORE, pursuant to Section 85.3 of the Utilities Commission Act and the Rules, the Commission approves the September 19, 1996 Confirmation Agreement between WKP and BPA for the purchase of firm energy and capacity for the months of November and December 1996, and January and February 1997.
