Barr, Deputy Chair ) and Acting Chair ) September 25, 1997 P.G. Bradley, Commissioner ) O R D E R WHEREAS: A. On September 5, 1997 Conquest Energy Inc. ("Conquest") applied to the British Columbia Utilities Commission ("the Commission") for an Agents/Brokers/Marketers ("ABM") Licence; and B. The Application was made pursuant to the Commission's MarchÊ11, 1993 Decision on Domestic Natural Gas Supply Rules which requires that any person intending to act in the capacity of an ABM to provide advice to, or act on behalf of, core market consumers purchasing gas directly in the Province of BritishÊColumbia, obtain an A/B/M Licence; and C. The Commission has reviewed the Application and, relying upon the information and representations made by Conquest in the Application, finds that approval of an ABM Licence, subject to conditions, is required. NOW THEREFORE the Commission orders as follows: 1.0 The Commission will issue to Conquest an ABM Licence for the period up to and including OctoberÊ31, 1998 upon receipt by the Commission of evidence acceptable to the Commission that a satisfactory gas delivery performance bond ("the Performance Bond") and gas supply contracts are in place to ensure Conquest's performance as an ABM. 2.0 The ABM Licence will be issued subject to the following conditions: 2.1 Conquest will carry out the undertakings set out in SectionÊ19 of its Application; 2.2 Conquest will comply with the approved ABM Code of Conduct; 2.3 Conquest will maintain the Performance Bond in full force and effect for the duration of the ABM Licence; 2.4 Conquest will, for the duration of the ABM Licence, maintain a Working Capital Position of at least $50,000 and a Current Ratio (ratio of current assets to current liabilities) of at least 1.10; .../2
2 2.5 The Commission may, at any time and without prior notice to Conquest, withdraw the ABM Licence for reasons the Commission, in its sole discretion, deems and considers sufficient; and 2.6 The ABM Licence and all copies of it shall remain the property of the Commission and Conquest will return these documents forthwith upon written request from the Commission. 3.0 Conquest is directed to file evidence of its Performance Bond and its gas supply contract(s) not less than 15Êdays prior to the start of gas deliveries.
