Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) January 2, 1997 O R D E R WHEREAS: A. On November 22, 1996 Trans Mountain Enterprises of British Columbia Limited ("TME") applied to the Commission for approval of a 1.3% increase in its tolls on the Jet Fuel Pipeline effective JanuaryÊ1, 1997 ("the Application"), pursuant to SectionÊ44 of the Pipeline Act ("the Act"); and B. The toll revision is the result of forecast increases in operating expenses, depreciation expense due to an updated depreciation study, income taxes and return on rate base which is partly offset by forecast increases in throughput; and C. On December 23, 1996 the Vancouver Airline Fuel Committee and the Airline Shippers ("the Airlines") complained about TME's Application and raised specific concerns about the proposed toll increase; and D. The Commission has reviewed the Application and the Airlines' complaint and finds that a decision on TME's tolls is required. NOW THEREFORE the Commission orders as follows: 1. The Commission, pursuant to the Act, orders the current tolls on the TME Jet Fuel Pipeline, to be interim, effective January 1, 1997. . . ./2
2 2. A meeting between TME, the Airlines and Commission Staff is to be held prior to the end of January, 1997 to attempt to reach a negotiated settlement to the Application and the Complaint. TME is required to notify all Shippers of the meeting and provide them with an opportunity to attend. 3. Any difference between the current tolls and the 1997 permanent tolls, when approved, are subject to refund or invoice, with interest calculated at the prime rate of the principal bank with which TME conducts its business.
