On NovemberÊ5, 1997 The Corporation of the City of Nelson (Òthe CityÓ) applied to the Commission for approval of Electrical Utility Amendment By-Law No. 2801, 1997 ("the By-Law") which revised the requirement for Security Deposits and Collection Procedures for all customers; and B. The By-Law deletes the requirements of By-Law No. 2020, 1983, and allows the City to recover a Security Deposit from all customers inside and outside of the City's boundaries, equivalent to 3 1/2 times the average monthly charge for bi-monthly accounts, and 2 1/2 times the average charge for monthly billed accounts; and C. The By-Law also amends the Collection Procedures for all accounts, to allow the City to transfer, every December 1st, all overdue accounts previously sent to a collection agency, to the property tax rolls as taxes in arrears; and D. The Commission has reviewed the By-Law and supporting material and finds that the amendments to the Security Deposit policy and Collection Procedures are appropriate and in the public interest. NOW THEREFORE the Commission orders as follows: 1. The Commission approves and accepts for filing the CityÕs Electrical Utility Amendment By-Law No.Ê2801, 1997, effective immediately. . . ./2
2. The City, by way of Customer Notice, is to inform all customers of the new Security Deposit requirements and the Collection Procedures including the transfer of overdue accounts to the tax rolls. 3. The City is to provide the Commission with a certified copy of the By-Law following all approvals.
