On SeptemberÊ18, 1995 a public hearing commenced into the Kanelk Transmission Company Limited (ÒKanelkÓ) April 28, 1995 Application for approval of rates, pursuant to Section 64 of the Utilities Commission Act, for transmission and other services provided by or through Kanelk to British Columbia Hydro and Power Authority (ÒB.C. HydroÓ) effective June 1, 1995, January 1, 1996 and January 1, 1997; and B. On OctoberÊ17, 1995 the Commission issued its Decision and Order No.ÊG-87-95 on the rate application and directed Kanelk and B.C. Hydro to conclude an agreement for the terms and conditions of service. The Commission, by Order No.ÊG-115-95, approved an interim rate increase for Kanelk effective JanuaryÊ1, 1996; and C. On OctoberÊ4, 1996 Kanelk applied to the Commission for approval of its proposed terms and conditions of service (Òthe ApplicationÓ), advised that it was unable to reach an agreement with B.C.ÊHydro, and requested that the matter be set down for hearing; and D. On NovemberÊ1, 1996, by Letter No.ÊL-49-96, the Commission requested that all parties involved review and comment on the Application by NovemberÊ29, 1996; and . . ./2
E. As no further progress has been made on the Application the Commission finds that a written hearing into KanelkÕs proposed terms and conditions of service is required. NOW THEREFORE the Commission orders as follows: 1. The Commission orders that the parties involved in the Application, namely B.C. Hydro as customer, and Fording Coal Limited as Intervenor, file with the Commission by August 15, 1997 their submissions on KanelkÕs Application for approval of its Terms and Conditions of Service. 2. Kanelk is to review and respond to all submissions by AugustÊ22, 1997, following which the Commission will make its Decision.
