The Commission has reviewed your complaint and advises that, while the May 1, 1997 letter sent by the utility could be misread, the charges issued by the utility are in accordance with its approved Electric Tariff in that there is a $75 minimum charge during the interim period prior to electrical meters being installed, and a metered rate of $0.075 per kW.h thereafter. The Commission notes that the utility has prorated the minimum charge to recognize the shorter interim billing period, which is advantageous to its customers and is a common practice followed by regulated utilities. Your complaint is therefore dismissed and the full charges billed by Silversmith are due and payable. Yours truly, Robert J.
