The Commission, by Order No. G-4-97, placed British Columbia Hydro and Power Authority’s (“B.C. Hydro”) application for a Certificate of Public Convenience and Necessity (“CPCN”) for Unit No. 4 at its Seven Mile Hydro-Electric Project (“the Application”) in abeyance until December 31, 1997, at which time B.C. Hydro would either cancel the Application, seek a further abeyance, or reactivate the Project; and B. Through a series of subsequent Orders the Commission extended the period during which the Application was held in abeyance until December 31, 1998; and C. On December 22, 1998, B.C. Hydro applied to the Commission to withdraw the Application for a CPCN without prejudicing the right to refile a new application when it believes that the public convenience and necessity warrant construction of the project; and D. The Commission has reviewed B.C. Hydro’s request and finds that withdrawal of the Application is in the public interest. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for B.C. Hydro its December 22, 1998 request to withdraw the Application for a CPCN for Unit No. 4 at its Seven Mile Hydro-Electric Project, without prejudicing B.C. Hydro’s right to refile a new application when it believes it to be in the public interest. 2. B.C. Hydro is to provide a copy of this Order to Intervenors previously registered in the proceeding set down by Order No. G-115-96.
