On January 15, 1999, British Columbia Hydro and Power Authority (“B.C. Hydro”) applied to the Commission to waive the requirement for a Certificate of Public Convenience and Necessity (“CPCN”) pursuant to Section 45 of the Utilities Commission Act (“the Act”) to relocate a 230 kV underground transmission cable (“the Project”) in the vicinity of Madison Avenue and the Lougheed Highway in Burnaby, B.C.; and B. The Commission, by Order No. G-44-89, requires that electrical utilities must apply for a CPCN for construction of any transmission lines rated at 138 kV and above; and C. There are no financial impacts to B.C. Hydro or its ratepayers associated with the Project and there are no significant socio-economic or environmental impacts associated with this relocation; and D. The Commission has reviewed the Project and finds that a variance to the requirements for a CPCN is required. NOW THEREFORE the Commission has determined that the Project is in the public interest and that, despite Order No. G-44-89, and pursuant to Section 45(4) of the Act, B.C.
