Ostergaard, Chair ) B.L. Clemenhagen, Commissioner ) August 19, 1999 K.L. Hall, Commissioner ) F.L. Leighton, Commissioner ) O R D E R WHEREAS: A. On June 25, 1999, West Kootenay Power Ltd. (“WKP”) applied to the Commission for a Certificate of Public Convenience and Necessity (“CPCN”) to upgrade its Subtransmission System with a new 63 kV circuit through the City of Penticton (“the City”) and for related substation modifications at the R.G. Anderson Terminal Station and at several substations in and around the City (“the Penticton Project”, “the Application”), pursuant to Section 45 of the Utilities Commission Act; and B. Commission Order No. G-74-99 dated July 12, 1999 established a Regulatory Agenda and Timetable and a public hearing process for the review of the Application; and C. By letter dated August 17, 1999, WKP informed the Commission that it has not completed the final design and alignment for the subtransmission system upgrade and does not anticipate that it would be completed prior to the September 20, 1999 start of the Public Hearing. WKP requested cancellation of the Regulatory Agenda and Timetable, and stated that is intends to divide the upgrade work covered by the Penticton Project into two projects for which it will file future applications; and C. The Commission has reviewed the request and finds that the Regulatory Agenda and Timetable and public hearing process should be cancelled. . . . /2
2 NOW THEREFORE the Commission orders as follows: 1. The Regulatory Agenda and Timetable and public hearing process into WKP’s Penticton Project that was established by Order No. G-74-99 is cancelled. 2. WKP is required to publish a Notice in local newspapers in the affected service area, or to provide radio announcements, in order to adequately notify its customers of the cancellation, prior to the August 24, 1999 Town Hall Meeting date. WKP is required to send a copy of this Order to the intervenors and interested parties in recent WKP proceedings who received a copy of Order No. G-74-99. 3. The Commission Secretary will provide notification of the cancellation to Intervenors and Interested Parties who have registered with the Commission in response to Order No. G-74-99.
