On April 16, 1999, the Commission issued Order No. G-41-99 approving a waiver, for 1999 only, of a provision in the Special Conditions contained in the British Columbia Hydro and Power Authority (“B.C. Hydro”) Rate Schedule 1848. The waiver states that a customer who terminates Real Time Pricing (“RTP”) service will be subject to a waiting period of one year from the date of termination before the customer can reapply for service; and B. Order No. G-41-99 also approved the specifics of the proposal, as set out in B.C. Hydro’s Letter dated March 18, 1999, and approved the waiver under the same terms and conditions for other RTP-related schedules; and C. As part of this Order, it was determined that returning customers would be deemed to have had their load retention CBL adjustment agreement continued until December 18, 1998, and business cases to support continuance of the CBL reduction from December 19, 1998 forward would be considered. D. On April 29, 1999, B.C. Hydro wrote to the Commission explaining its proposed implementation of Order No. G-41-99; and E. On April 30, 1999, the Commission issued Order No. G-45-99 approving the implementation methodology proposed by B.C. Hydro; and …/2

Hydro stated that it would make applications to the Commission on behalf of those customers with previous CBL reductions wishing to return to the RTP program and seeking an extension of their previous CBL reduction for the period from December 19, 1998 to August 1, 1999; and G. Any CBL reductions approved by the Commission for the period from December 19, 1998 to August 1, 1999, would be the basis for B.C. Hydro's determination of the Billing Adjustment and the April 1999 Adjustment as described in Commission Order No. G-45-99; and H. On May 11, 1999, B.C. Hydro made an application to extend RTP Supplementary Agreements (concerning load-retention CBL reductions) for the period from December 19, 1998, to August 1, 1999, in the cases of Fiberco Pulp, Quesnel River Pulp, Sterling Pulp Chemicals, and CXY Chemicals (North Vancouver and Nanaimo); and I. The Commission has reviewed the application from B.C. Hydro and the letters from affected customers. NOW THEREFORE the Commission approves for B.C. Hydro extensions to the relevant Supplementary Agreements for the period from December 19, 1998, to August 1, 1999, for Fiberco Pulp, Quesnel River Pulp, Sterling Pulp Chemicals, and CXY Chemicals (North Vancouver and Nanaimo).
