Leighton, Commissioner ) O R D E R WHEREAS: A. On August 19, 1999 the Commission, by Order No. G-85-99, approved an amended Regulatory Timetable into the May 21, 1999 application by Central Heat Distribution Limited (“CHDL”) for approval of a Permanent Operating Agreement with the City of Vancouver (“the City”) pursuant to Section 32 of the Utilities Commission Act; and B. On August 30, 1999 Bull, Housser & Tupper, representing CHDL, advised the Commission that an agreement on the outstanding issues with the City had been reached and that both parties requested the Commission to adjourn indefinitely the proceedings set down by Commission Orders No. G-77-99 and G-85-99. Following completion of documentation and internal approvals, a signed agreement will be submitted to the Commission by CHDL for approval; and C. The Commission has reviewed the request and finds that an adjournment of the Regulatory Timetable, including the public hearing, is in the public interest. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for CHDL and the City an indefinite adjournment of the public hearing and Regulatory Timetable established by Orders No. G-77-99 and G-85-99. 2. CHDL is to file with the Commission a copy of the signed new operating agreement with the City for approval as soon as possible.
