Ostergaard, Chair ) P.G. Bradley, Commissioner ) August 9, 2001 B.L. Clemenhagen, Commissioner ) O R D E R WHEREAS: A. RFP Power Ltd. (“RFP Power”) owns and operates a steam and electric energy generation power plant (“the Power Plant”) in Armstrong, B.C.; and B. Riverside Forest Products Limited (“Riverside”) owns and operates a lumber and plywood facility (“the Facility”) adjacent to the Power Plant; and C. RFP Power and Riverside propose to enter into a steam supply agreement, which will set out the terms upon which steam will be supplied to Riverside for use at the Facility; and D. RFP Power is a wholly-owned subsidiary of Riverside; and E. On May 31, 2001, RFP Power applied to the British Columbia Utilities Commission (“the Commission”) pursuant to Section 88(3) of the Utilities Commission Act (“the Act”) for an Order exempting RFP Power from certain provisions of the Act in respect of the production, delivery and sale of steam to Riverside; and F. The Commission has considered RFP Powers application and is satisfied that an Order exempting RFP Power from certain sections of the Act properly conserves the public convenience and interest; and G. On August 2, 2001, the approval of the Lieutenant Governor in Council was given to the said exemption by Order in Council No. 739, 2001 attached to this Order as Appendix A”. . . ./2
2 NOW THEREFORE the Commission, pursuant to Section 88(3) of the Act, approves the application by RFP Power for an exemption from the provisions of the Act, other than Part 2 and Section 99, in respect of the production, delivery and sale of steam to Riverside, subject to the following conditions: 1. This Order is effective August 9, 2001; and 2. The Commission may, pursuant to Section 99 of the Act, reconsider, vary or rescind an Order made by it.
