Ostergaard, Chair ) P.G. Bradley, Commissioner ) December 18, 2002 K.L. Hall, Commissioner ) O R D E R WHEREAS: A. On October 31, 2002, Central Heat Distribution Limited (“CHDL”) filed with the Commission, pursuant to Sections 58 and 61 of the Utilities Commission Act (“the Act”), an application to increase its Steam Tariff Schedule of Charges by 6.4 percent effective January 1, 2003, on a permanent basis (“the Application”); and B. On October 31, 2002, CHDL notified all customers of the requested increase in steam charges; and C. Commission Order No. G-82-02 set an intervenor registration deadline of November 29, 2002 and required CHDL to provide its current and prospective customers with a copy of the Order and an Executive Summary of the Application by November 22, 2002. A timetable for further review of the Application would be made by a future Order that would be sent to all Registered Intervenors; and D. No customers intervened by the registration deadline; and E. On December 9, 2002, Commission staff issued Information Requests, which CHDL responded to on December 13, 2002; and …/2
2 F. CHDL undertook to revise its Application as a result of the information responses, which may result in permanent 2003 rates not being established prior to January 1, 2003; and G. The Commission considers that interim rates and a regulatory timetable should be established for review of the Application. NOW THEREFORE the Commission orders as follows: 1. The current rates of CHDL are set as interim effective January 1, 2003. 2. The review of the CHDL Application is to proceed as a Negotiated Settlement Process with a timetable for settlement discussions to be arranged between CHDL and Commission staff.
