Nicholls, Commissioner ) O R D E R WHEREAS: A. On July 30, 2002, Toby Creek Utilities Co. Ltd. (“TCU”) applied to decrease its Gas Cost Recovery Charge for its Panorama, B.C. propane grid system, effective August 1, 2002, from $8.57 to $7.49 per GJ. On September 19, 2002, TCU asked that this application be withdrawn; and B. On September 19, 2002, the Commission by Order No. G-67-02, approved for TCU its Gas Cost Recovery Account commencing June 1, 2002, with an initial zero balance; and C. On September 26, 2002, TCU filed an August 31, 2001 Agreement for the supply of bulk propane to its Panorama, B.C. grid system, between its agent BCG Services Inc. and MP Energy Partnership for the period September 1, 2001 to August 31, 2003; and D. On September 30, 2002, TCU applied to the Commission for approval to reduce its Gas Cost Recovery Charge from $8.57 per GJ to $7.61 per GJ, including fuel and unaccounted for gas at 4 percent, effective November 1, 2002; and E. The Commission has reviewed the filings. NOW THEREFORE the Commission orders as follows: 1. The Commission accepts TCUs request to withdraw its July 30, 2002 application. . . ./2

Pursuant to Sections 58, 60 and 61 of the Utilities Commission Act (“the Act”) the Commission approves for TCU its September 30, 2002 application for a reduction in its Gas Cost Recovery Charge from $8.57 per GJ to $7.61 per GJ effective November 1, 2002. TCU is to advise all its customers of the change in propane rates effective November 1, 2002 by way of a bill insert notice. 3. Pursuant to Section 71 of the Act and the Rules for Energy Supply Contracts, the Commission accepts for filing the August 31, 2001 Agreement between BCG Services Inc. and MP Energy Partnership for the supply of bulk propane to the TCU propane grid system at Panorama for the period September 1, 2001 to August 31, 2003.
