On December 22, 2003, The Corporation of the City of Nelson (“the City”) applied to the Commission for approval of an Electrical Utility Amendment By-Law (as amended January 5, 2004) to increase its electrical rates by 2.50 percent, effective January 1, 2004; and B. The By-Law schedules include rates pertaining to the provision of electrical service to customers outside its municipal boundaries; and C. The electrical utility rate increase is required due to increases in costs, including an interim increase in power purchase costs from the City’s supplier, Aquila Networks Canada (British Columbia) Ltd., that was approved by Commission Order No. G-91-03; and D. The City’s Application confirms that the City will apply any difference between the Aquila interim and final approved rates to the City’s 2005 rates; and E. The Commission has reviewed the amended By-Law and rate schedules and finds that an electrical utility rate increase to all customers is required. . . ./2
2 NOW THEREFORE the Commission orders as follows: 1. The Commission approves and accepts for filing for the City Electrical Utility Amendment By-Law No. 2997, 2004 incorporating a 2.50 percent rate increase to all customers, effective January 1, 2004. 2. The City will return to all customers any excess revenue recovered between its rates and the final rates approved by the Commission for its electrical supplier, Aquila Networks Canada (British Columbia) Ltd. 3. The City, by way of a customer notice included in the next billing, is to inform customers of the rate increase. 4. The City is to provide the Commission with a final certified copy of the By-Law following all approvals.
