Hobbs, Chair O R D E R WHEREAS: A. Section 46(1) of the Utilities Commission Act (“the Act”) states that an applicant for a Certificate of Public Convenience and Necessity (“CPCN”) must file with the British Columbia Utilities Commission (“Commission”) information, material, evidence and documents that the Commission prescribes; and B. On December 21, 1999 the Commission, by Order No. G-133-99, issued its Application Requirements for CPCNs (CPCN filing requirements) which established the required procedure and information for CPCN applications under the Act; and C. The Commission has reviewed the CPCN filing requirements and considered its experience with CPCN application reviews to date and has prepared revised draft CPCN Guidelines for consultation with public utilities and other interested parties during the period January 28 to February 20, 2004; and D. The Commission has considered the comments received and, concurrently with this Order, has issued Letter No. L-18-04 which establishes the Commissions CPCN Application Guidelines. NOW THEREFORE the Commission cancels Commission Order No. G-133-99 effective the date of this Order.
