Kelsey, Panel Chair and ) Commissioner ) July 21, 2004 P.E. Vivian, Commissioner ) N.F. Nicholls, Commissioner ) O R D E R WHEREAS: A. On February 27, 2004, the Insurance Corporation of British Columbia (“ICBC”) submitted filings (the Submission”) relating to ICBC Performance Measures (“ICBC PM”) and ICBC Basic Insurance Information Sharing (“ICBC BIIS”). The Submission is in response to directions issued by the British Columbia Utilities Commission (“BCUC, Commission”) in its Decision dated November 12, 2003 and Letter No. L-2-04 wherein the Commission Panel accepted ICBCs proposal (with certain variations) regarding regulatory filings in 2004; and B. The Commission, by way of Order No. G-23-04, established the Regulatory Agenda and Timetable for a negotiated settlement process into the ICBC filings; and C. On April 21 through 23, 2004, the filings were reviewed by all active participants and a Negotiated Settlement was reached among the participants, which was circulated to all Registered Intervenors and the Commission Panel on May 7, 2004; and D. On May 20, 2004, the Commission, by Order No. G-49-04, approved for ICBC the Negotiated Settlement Agreement that was issued on May 7, 2004; and . . ./2

On May 10, 2004, the Office & Professional Employees International Union, Local 378 [now known as COPE, Local 378 (“COPE”)] applied for a Participant Assistance Cost Award for its participation in the ICBC filings and negotiated settlement sessions; and F. The Commission requested additional information from the COPE and received responses thereto on July 5, 2004; and G. The Commission has reviewed the application for a participant assistance cost award with regard to the criteria and rates set out in Commission Order No. G-15-0-4. NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 118(1) of the Utilities Commission Act, the Commission awards $1,425.00 to COPE for its participation in the Negotiated Settlement process for ICBCs Application for Performance Measures and Basic Insurance Information Sharing. 2. ICBC is directed to reimburse the COPE for the total amount awarded in a timely fashion. DATED at the City of Vancouver, in the Province of British Columbia, this 30th day of July 2004.
