Kelsey, Commissioner L.A. O’Hara, Commissioner February 17, 2005 O R D E R WHEREAS: A. On October 9, 2003 Aquila Networks Canada (British Columbia) Ltd. (now known as FortisBC Inc. (“FortisBC”)) requested approval for a change to Tariff Sheet TC 18 to make it identical to BC Hydro’s Electric Tariff Page B-27-1 tariff regarding liability provisions in the Terms and Conditions of Service to Customers; and B. On October 29, 2003 the Commission notified FortisBC that it would defer approval of the change until after the BC Hydro 2005/06 Revenue Requirements Application and Decision; and C. The BC Hydro Revenue Requirements Decision was rendered on October 29, 2004; and D. The Commission has considered the request and finds there should be no inconsistency with the BC Hydro Tariff Page B-27-1 and therefore finds that approval of revisions to FortisBC Inc.’s Electric Tariff Sheet TC 18 is necessary. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for FortisBC amendments to Electric Tariff, Terms and Conditions of Service and First Revision of Sheet TC 18 Interruptions and Defects in Service, as requested by its letter dated October 9, 2003.
