Kelsey, Panel Chair and Commissioner February 16, 2005 P.E. Vivian, Commissioner N.F. Nicholls, Commissioner O R D E R WHEREAS: A. On July 5, 2004, the Insurance Corporation of British Columbia (“ICBC”) submitted an application for approval of the Financial Allocation Methodology and a filing relating to Road Safety and Collection of Date relating to Age, Sex and Marital Status (“Submission 1”). On July 12, 2004, ICBC submitted a filing (“Submission 2”) containing Actuarial and 2005 Financial Information for Universal Compulsory Automobile Insurance (“UCAI”). Submissions 1 and 2 are in response to directions issued by the British Columbia Utilities Commission (“BCUC, Commission”) in its Decision dated November 12, 2003 and the Negotiated Settlement Agreement, approved by Order No. G-49-04, regarding regulatory filings in 2004; and B. The Commission held an Oral public hearing into the filings which commenced on October 5, 2004 in Vancouver, BC and concluded on November 22, 2004 with Final Reply argument by ICBC; and C. On January 19, 2005 the Commission by Order No. G-9-05 issued its Decision; and D. British Columbia Public Interest Advocacy Centre representing the British Columbia Old Age Pensioners Organization et al., (“BCOAPO”) applied on November 24, 2004 for a Participant Assistance Cost Award for its participation in the proceedings; and . . ./2
2 E. The Consumers Association of Canada (BC Branch) (“CACBC”) on December 10, 2004 applied for a Participant Assistance Cost Award for its participation in the proceedings; and F. The Commission has reviewed the requests for cost awards with regard to the criteria and rates set out in Commission Order No. G-15-04; and G. The Commission Panel confirmed that BCOAPO and CACBC participated in and contributed to the proceedings. NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 118(1) of the Utilities Commission Act, the Commission awards funds to the following for their participation in the ICBC proceedings as follows: Participant Funding Request BCOAPO $64,277 CACBC $25,145 2. ICBC is directed to reimburse BCOAPO and CACBC for the total amounts awarded in a timely fashion. DATED at the City of Vancouver, in the Province of British Columbia, this 2nd day of March 2005.
