(“FortisBC”) applied to the Commission for a Certificate of Public Convenience and Necessity (“CPCN”) for the Kettle Valley Distribution Source Project; and B. The Commission in the 2005-2024 System Development Plan and 2005 Resource Plan Decision (Order No. G-52-05) designated this project as requiring a CPCN; and C. The Commission has received several letters of comment from a concerned land owner and from participants to the FortisBC 2006 Capital Plan review regarding this project. NOW THEREFORE the Commission orders as follows: 1. The Commission requires the application to be reviewed by a written public hearing process according to the Regulatory Timetable attached as Appendix A. 2. FortisBC is to publish notification of the regulatory timetable, attached as Appendix B, in local papers by Friday, November 18, 2005. 3. The Commission determines that there will be no participant funding available for this proceeding. Application for a Certificate of Public Convenience and Necessity to Construct and Operate the Kettle Valley Distribution Source Project NOTICE OF WRITTEN PUBLIC HEARING PROCESS THE APPLICATION On October 11, 2005, FortisBC applied to the Commission for approval to construct and operate new transmission and distribution lines, including substation in the Kettle Valley (“the Kettle Valley Project”). The Kettle Valley Project will consist of the construction of a distribution source substation and conversion of the existing 13 kV distribution system to 25kV that has an estimated cost of $21.48 million. THE REGULATORY PROCESS The Commission has established a Written Public Hearing Process for the review of the Application. The Commission has determined that no participant funding will be available for this proceeding. PUBLIC INSPECTION OF THE DOCUMENTS The FortisBC CPCN Application and supporting material will be made available for inspection at the Utility’s Head Office in Kelowna at the Landmark IV, 5 th Floor, 1628 Dickson Avenue, Kelowna, BC, its Trail Office at 1290 Esplanade, Trail, BC, and at the Public Library in Grand Forks, B.C. and the British Columbia Utilities Commission, Sixth Floor, 900 Howe Street, Vancouver, BC, V6Z 2N3. REGISTERING TO PARTICIPATE Unless they have already registered, persons who expect to actively participate in the FortisBC proceeding should register as Intervenors with the Commission, in writing, by Wednesday, November 30, 2005. Intervenors will receive copies of the Application, all correspondence and filed documentation.
