Dunn & Atchison: Re: British Columbia Transmission Corporation (“BCTC”) Project No. 3698395/Order No. G-70-05 Certificate of Public Convenience and Necessity (“CPCN”)Application Vancouver Island Transmission Reinforcement Project (“VITR”) By Order No. G-70-05 (Exhibit A-1) a Procedural Conference regarding the regulatory review of the BCTC Application for the VITR was established for August 4, 2005. Order No. G-70-05 also identified procedural matters to be heard at the Procedural Conference. By letter dated July 23, 2005 (Exhibit C3-4), Tsawwassen Residents Against Higher Voltage Overhead Lines (“TRAHVOL”) requests an extension for requests for intervenor status and a delay of the Procedural Conference. Requests by intervenors and interested parties to register with the Commission will be accepted after Friday, July 29, 2005 and until Friday, September 16, 2005. Intervenors and interested parties can expect to receive filings commencing from their date of registration. The request for a delay of the Procedural Conference scheduled for August 4, 2005 is denied. The Regulatory Agenda expected to be established following the Procedural Conference may include filing dates that are earlier than September 16, 2005. Participants that register after a filing date established by the Regulatory Agenda should not expect an extension of the earlier filing date. In the Application (Exhibit B-1) at Section 3, page 71, Figure 3-33, BCTC includes a conceptual schedule for the review of the Application. The conceptual schedule contemplates a Commission decision by February 17, 2006. At Section 4, page 108, BCTC identifies one of the Project risks as follows: Schedule delay if CPCN approval is not receive by February 1, 2006”. At Section 3, page 73, BCTC states that: “… no irreversible contractual commitments will be made prior to receipt of a CPCN. BCTC presently proposes to award a cable contract and perhaps a contract for the PST prior to receipt of the environmental approvals and other permits later in 2006. This is necessary to maintain the Project schedule because of the long lead time required to design, manufacture and install submarine cable”. In the Application at Section 3, page 72, Figure 3-34, the proposed schedule also suggests that the commencement date for contract work for the submarine cable system is April 6, 2006. …/2

L-62-05 At the Procedural Conference, counsel for BCTC should be prepared to speak to the significance of the CPCN decision date (either February 1 or February 17, 2006), to the contract date for the cable system and also to the in-service date of October 31, 2008. Intervenors should be prepared to speak to the review schedule proposed by BCTC at page 71 of the Application, recognizing that the dates established by Order No. G-70-05 for both the Procedural Conference and the response to Information Request No. 1 are later than shown on the schedule.
