Hobbs, Chair L. A. Boychuk, Commissioner January 3, 2006 O R D E R WHEREAS: A. On December 17, 2004 Pacific Northern Gas Ltd. (“PNG”, “PNG-West”) applied to the Commission for approval of its 2005 Revenue Requirements (“the 2005 RR Application”) and to amend its rates on an interim and final basis, effective January 1, 2005, pursuant to Section 89 and 58 of the Utilities Commission Act (“the Act’); and B. On September 9, 2005 the Commission issued its Decision on PNG’s Income Trust Application and concluded the 2005 RR Application would be reviewed by a separate process; and C. By Letter No. L-84-05 the Commission scheduled a Negotiated Settlement Process for the 2005 RR Application; and D. On November 17, 2005 the Commission, by Order No. G-120-05, approved for PNG the Settlement Agreement for the 2005 RR Application; and E. On November 17, 2005 The British Columbia Public Interest Advocacy Centre (“BCPIAC”) submitted a bill of costs on behalf of the BC Old Age Pensioner’s Organization et al. (“BCOAPO”) for its participation in the Negotiated Settlement proceeding. The bill of costs was revised on November 25, 2005; and . . ./2
2 F. Commission staff have advised the Panel that BCPIAC/BCOAPO participated in the Negotiated Settlement proceeding and contributed to the Commission’s approval; and G. The Commission has reviewed the application for a cost award with regard to the criteria and rates set out in Order No. G-15-04. NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 118(1) of the Act, the Commission awards $11,775.05 to BCPIAC/BCOAPO for its participation in PNG’s 2005 RR Application and Negotiated Settlement process. 2. PNG is directed to reimburse BCPIAC/BCOAPO for the total amount of $11,775.05 in a timely fashion.
