Anderson, Commissioner November 29, 2006 O R D E R WHEREAS: A. As part of British Columbia Hydro and Power Authority (“BC Hydro”) F2007 and F2008 Revenue Requirements Application (“F07/F08 RRA”) Negotiated Settlement Agreement issued November 6, 2006, there was no agreement among the Parties that expenditures referred to in the F07/F08 RRA in regard to the Aberfeldie Redevelopment Project were, or were not, in the interests of persons within British Columbia who receive, or who may receive, service from BC Hydro; and B. It was also agreed that the Commission’s current review of BC Hydro’s proposed expenditures in regard to the Aberfeldie Redevelopment Project (initiated by the filing of the F07/F08 RRA) would continue and could, by Commission order, continue as an application for a certificate of public convenience and necessity; and C. By letter dated November 15, 2006 to the Commission and copied to the Intervenors in the F07/F08 RRA process, BC Hydro advised that with the filing contained in that letter, it believed it had placed on the record, or identified, all information materially relevant to the Aberfeldie Redevelopment Project; and D. By letter dated November 20, 2006, the Commission requested Intervenors in the F07/F08 RRA process to provide their positions as to whether more information is required regarding the Aberfeldie Redevelopment Project, and the process by which the application should proceed; and …/2
2 E. The Commission has received several letters from Intervenors in the F07/F08 RRA process regarding this project. NOW THEREFORE the Commission orders as follows: 1. BC Hydro is directed to submit an application by Wednesday December 6, 2006 for a Certificate of Public Convenience and Necessity (“CPCN”) to redevelop the Aberfeldie Redevelopment Project. 2. The Commission requires the application to be reviewed by a written public hearing process according to the Regulatory Timetable attached as Appendix A. 3. BC Hydro is directed to publish notification of the regulatory timetable, attached as Appendix B, in local papers (Vancouver and East Kootenay) as soon as possible and at least by Friday, December 8, 2006. THE REGULATORY PROCESS The Commission has established a Written Public Hearing Process for the review of the Application. PUBLIC INSPECTION OF THE DOCUMENTS The BC Hydro Certificate of Public Convenience and Necessity Application and supporting material will be made available for inspection at the BC Hydro’s Head Office in Vancouver at 17th Floor, 333 Dunsmuir Street, Vancouver, BC, BC Hydro’s Cranbrook District Office at 629 Industrial Road, Cranbrook, BC, and the British Columbia Utilities Commission, Sixth Floor, 900 Howe Street, Vancouver, BC, V6Z 2N3. REGISTERING TO PARTICIPATE Unless they have already registered, persons who expect to actively participate in the BC Hydro proceeding should register as Intervenors with the Commission, in writing, by Friday, December 15, 2006. Intervenors will receive copies of the Application, all correspondence and filed documentation. Persons not expecting to actively participate, but who have an interest in the BC Hydro proceeding should register as Interested Parties with the Commission, in writing, by Friday, December 15, 2006. Interested Parties will receive a copy of the Application’s Executive Summary and all Orders issued.
