Kelsey, Commissioner March 14, 2007 L.A. Zaozirny, Commissioner O R D E R WHEREAS: A. Commission Order No. G-5-05 approved for Terasen Gas Inc. (“Terasen Gas”) Rate Schedule 22B Tariff Supplements No. G-14, G-15 and G-19 with Elk Valley Coal for its coal mine site operations at Fording River, Greenhills and Line Creek, respectively, effective November 1, 2004 for a period of two-years; and B. On March 8, 2007, Terasen Gas requested approval of an agreement dated January 1, 2007 with Elk Valley Coal Corporation for its Line Creek Operations as Rate Schedule 22B Tariff Supplement No. G-19, to replace Tariff Supplement No. G-19 that was approved by Order No. G-5-05; and C. Replacement Tariff Supplement No. G-19 provides an interruptible rate of $0.284 per GJ for the summer period from April 1 through October 31, and during the winter period of November 1 through March 31 for interruptible volumes delivered in excess of 10 percent of the contracted Daily Transmission Quantity (“DTQ”) times the number of days in the month. Fording Coal Limited agrees that it will not decrease its DTQ at the mine site during the term of the Tariff Supplement; and D. The interruptible rate in Tariff Supplement No. G-19 will be adjusted annually based on Rate Schedule 22B rates, and the Tariff Supplement will continue in effect from year to year unless terminated by notice from either party; and …/2
2 E. The Commission has reviewed the Application and finds that it should be approved. NOW THEREFORE the Commission approves for Terasen Gas the Rate Schedule 22B Transportation Service Agreement dated January 1, 2007 with Elk Valley Coal Corporation for its Line Creek Operations as Tariff Supplement No. G-19, effective January 1, 2007.
