(“FortisBC”) applied (the “Application”) to the British Columbia Utilities Commission (“Commission”) for a Certificate of Public Convenience and Necessity (“CPCN”) for the Ellison Substation Project (“the Project”); and B. FortisBC states that the Project is estimated to cost $ 15.77 million and is required to meet the added load growth, capacity requirements and the backup supply planning criteria for the north Kelowna area; and C. FortisBC, after considering various options, proposes to construct a new substation in the Ellison area of north Kelowna, convert 6.0 kilometers of existing distribution and transmission circuits to 138 kV transmission and connect the new substation to the area distribution network; and D. In response to feedback received in the July 2006 public information session FortisBC has identified a site for the proposed substation which is not in the ALR, and is in negotiations with the landowner; and E. The Commission considers that a public hearing is required to hear submissions on the proposed Ellison Substation Project. . . ./2

The Commission establishes an oral public hearing process for the review of the Application and proceeds with a Regulatory Timetable as attached in Appendix A. 2. FortisBC shall publish the Notice of Public Hearing, attached as Appendix B, in local papers by November 17, 2006, or as soon thereafter as it is possible to do so. CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY APPLICATION FOR THE ELLISON SUBSTATION PROJECT NOTICE OF PUBLIC HEARING THE APPLICATION On October 27, 2006, FortisBC Inc. applied to the British Columbia Utilities Commission (“the Commission”) for approval of a Certificate of Public Convenience and Necessity (“CPCN”) to construct and operate the proposed Ellison Substation and Transmission project that is projected to cost $ 15.77 million. The Project consists of a new substation in the Ellison area of north Kelowna, converting 6.0 kilometers of existing distribution and transmission circuits to 138 kV transmission and connecting the new substation to the area distribution network. The substation location is immediately adjacent to the existing transmission and distribution corridors, so no new line route will be required. An existing 5.2 kilometer section of 13kV distribution circuit between the Duck Lake Substation and the proposed Ellison site will have a 138 kV transmission circuit overbuilt on the existing poles. This will tie into an existing 0.8 kilometers of line which is already constructed to 138kV standards. The project is required to meet the load growth, capacity requirements and the backup supply planning criteria for the north Kelowna area. THE REGULATORY PROCESS Commission Order No. G-140-06 established the Regulatory Timetable for the review of the FortisBC Inc. CPCN Application by way of an Oral Public Hearing to be held in Kelowna, B.C., commencing on Tuesday, January 9, 2007 at 11:00 a.m. at the Grand Okanagan Hotel. An evening session of the Hearing with the primary purpose of receiving submissions by participants will be held on January 9, 2006 commencing at 7:00 p.m. The detailed Regulatory Timetable can be reviewed on the Commission’s website http://www.bcuc.com >Proceedings&Agendas>Current Applications. INTERVENTIONS Persons who expect to actively participate in the FortisBC proceeding should register as Intervenors with the Commission, in writing, by Friday, December 1, 2006, identifying their interest in the CPCN Application. Intervenors will receive copies of the CPCN Application as well as all correspondence and filed documentation and should provide an e-mail address if available. Persons not expecting to actively participate in the FortisBC proceeding, but who have an interest in the Project and have not already registered, should register as Interested Parties with the Commission, in writing, by Friday, December 1, 2006, identifying their interest in the CPCN Application. Interested Parties will receive a copy of the Executive Summary, the Application section and all Orders issued.
All submissions and/or correspondence received from active participants or the general public relating to the Application will be placed on the public record and posted to the Commission’s web site.
