Hobbs, Chair June 20, 2007 O R D E R WHEREAS: A. On June 29, 2004 the Commission, by Order No. G-61-04 and on April 27, 2006 by Order G-48-06, approved for British Columbia Transmission Corporation (“BCTC”) a Reliability Management System (“RMS”) Agreement which includes a Reliability Criteria (“RC”) Agreement and includes five amendments previously approved by the Commission; and B. The Commission notes that British Columbia Hydro and Power Authority (“BC Hydro”) and FortisBC Inc. (“FortisBC”) are signatories to the Fifth Amendment Agreement and that BC Hydro and FortisBC are also signatories to the RMS and RC Agreements and amendments previously approved by the Commission; and C. On May 28, 2007, BCTC, BC Hydro and FortisBC filed the Sixth Amendment of the Reliability Criteria Agreement – Canadian Language Version for Commission approval; and D. BCTC, BC Hydro and FortisBC participated in the process that led to the WECC approval of the changes incorporated into the Sixth Amendment of the Reliability Criteria Agreement – Canadian Language Version; and . . ./2

The Commission notes that these changes, included in the Sixth Amendment of the Reliability Criteria Agreement – Canadian Language Version, do not impact BCTC as the transmission operator of BC Hydro’s transmission facilities since BCTC is fully compliant; and F. The Commission notes that these changes, included in the Sixth Amendment of the Reliability Criteria Agreement – Canadian Language Version, do not impact BC Hydro’s obligations in relation to RMS data submitted to WECC; and G. The Commission notes that these changes, included in the Sixth Amendment of the Reliability Criteria Agreement – Canadian Language Version, do impact FortisBC as FortisBC is non-compliant and has filed a Mitigation Plan with WECC for training and certification of FortisBC’s transmission operators by December 31, 2007 and that a requested effective date of the Commission Order for FortisBC be January 1, 2008; and H. BCTC, BC Hydro and FortisBC support the amendments proposed in the Sixth Amendment of the Reliability Criteria Agreement – Canadian Language Version. NOW THEREFORE pursuant to Sections 23 and 38 of the Utilities Commission Act, the Commission approves the Sixth Amendment of the Reliability Criteria Agreement – Canadian Language Version with the Western Electricity Coordinating Council effective July 1, 2007 for BC Hydro and BCTC, and effective January 1, 2008 for FortisBC.
