Milbourne, Commissioner October 25, 2007 O R D E R WHEREAS: A. British Columbia Hydro and Power Authority (“BC Hydro”) filed on March 17, 2006, pursuant to sections 58 to 61 of the Utilities Commission Act (“the Act”), an application (“Application”) for approval of the Customer Baseline Load (“CBL”) for each customer account to be served under BC Hydros Stepped Rate, Rate Schedule (“RS”) 1823; and B. Customer Baseline Load Determination Guidelines (“CBL Guidelines”) were approved by Commission Orders No. G-79-05 and G-19-06, and those Guidelines established a process for periodic revisions to a customers CBL; and C. Pursuant to Commission Letter No. L-63-06, BC Hydro filed the CBL Guidelines with the Commission as Electric Tariff Supplement No. 74 (“TS 74”); and D. By Order No. G-138-06 dated November 8, 2006, the Commission approved final CBLs for each RS 1823 customer; and E. Pursuant to Letter No. L-69-06 dated November 7, 2006, and issued concurrently with Order No. G-138-06, the Commission sought comments on issues concerning BC Hydros CBL Adjustment Tariff Practices (“Tariff Practices”); and F. In response to Letter No. L-69-06, the Commission received submissions from the Joint Industry Electricity Steering Committee (“JIESC”) and Highland Valley Copper on November 17, 2006. BC Hydro filed its reply submissions on November 24, 2006, including revised Tariff Practices that address certain of the submissions of the JIESC and Highland Valley Copper; and . . ./2
BRITISH COLUMBIA UTILITIES COMMISSION ORDER NUMBER G-129-07 2 G. By Order No. G-156-06 dated December 7, 2006, the Commission approved the CBL Adjustment Tariff Practices filed by BC Hydro in its November 24, 2006 submission, as revised by the Order, and indicated that the Tariff Practices would be appropriate for the purpose of providing guidance to the parties in applying the CBL Guidelines in respect of future CBL adjustment requests, but only where the CBL Guidelines are silent and never when inconsistent with the CBL Guidelines; and H. By Application dated October 5, 2007, BC Hydro seeks Commission approval of certain CBLs that have been revised pursuant to Tariff Supplement No. 74. NOW THEREFORE the Commission orders as follows: 1. The Customer Baseline Loads (“CBLs”) in the column titled CBL for Final Approval FY08 in Appendix A of the CBL F2008 Application are approved on an interim basis effective April 1, 2007. 2. Pursuant to Letter No. L-85-07 issued concurrently with this Order, the Commission requests that those Rate Schedule 1823 customers, whose CBL has been revised, confirm in writing to the Commission by November 9, 2007 whether they agree with or dispute the revised CBL that BC Hydro has proposed for them. 3. BC Hydro is directed to provide a copy of this Order and Letter No. L-85-07, attached to this Order, to all of its RS 1823 customers as soon as possible. 4. If there are disputes, the Commission will establish a process to review the disputes. 5. Once the Commission has approved the final CBLs, BC Hydro is to make any necessary billing adjustments as set out in section 6.2.3 of Tariff Supplement No. 74.
