Pullman, Chair December 19, 2007 O R D E R WHEREAS: A. BC Hydro filed on December 14, 2007 pursuant to Section 45 (6.1)(b) of the Utilities Commission Act (the Act”) an application for the Standing Offer Program (“SOP”); and B. Policy Action No. 11 of the Provincial Governments 2007 Energy Plan: A Vision for Clean Energy Leadership (“2007 Energy Plan”) directs BC Hydro to establish a standing offer for clean electricity projects up to 10 megawatts (MW); and B. BC Hydro seeks an order pursuant to Section 45(6.2)(b) of the Act which determines expenditures of $514,000 required to conduct the implementation phase of the SOP, including administration and program review for the first two years, are in the interests of persons within British Columbia who receive or may receive, service from BC Hydro; and C. BC Hydro is of the view that the SOP Application should be the subject of a Commission-sponsored negotiated settlement process (“NSP”); and D. BC Hydro proposed a regulatory timetable for the review of the Application allowing for one round of Information Requests followed by a NSP to commence on February 13, 2008; and E. The Commission has reviewed BC Hydros proposed regulatory timetable and considers that the establishment of a Regulatory Timetable and the NSP is warranted. . . ./2
2 NOW THEREFORE the Commission orders as follows: 1. The Commission will review the Application allowing for one round of Information Requests and will hold an NSP in Vancouver, B.C. A Regulatory Timetable is attached as Appendix A to this Order. 2. BC Hydro is to provide a copy of this Commission Order and Regulatory Timetable to all parties who participated in other BC Hydros SOP First Nations and stakeholder engagement process during the past year. 3. BC Hydro will publish, as soon as possible, in display-ad format, the Notice of Application for Approval of the Standing Offer Program attached as Appendix B to this Order, in the Vancouver Sun and Province, the Victoria Times Colonist. 4. Those persons wishing to participate in BC Hydros SOP Application review are to advise the Commission Secretary in writing of their intention to do so, no later than Monday, January 14, 2008. THE REGULATORY PROCESS Commission Order No. G-169-07 established the Regulatory Timetable for the review of the Application by way of a Written Public Hearing. INTERVENTIONS Persons who expect to actively participate in the BC Hydro proceeding should register as Intervenors with the Commission, in writing, by Monday, January 14, 2008, identifying their interest in the Application. Intervenors will receive copies of the Application as well as all correspondence and filed documentation and should provide an e-mail address if available.
Persons not expecting to actively participate in the BC Hydro proceeding, but who have an interest in the Application, should register as Interested Parties with the Commission, in writing, by Monday, January 14, 2008, identifying their interest in the Application. Interested Parties will receive a copy of the Executive Summary of the Application and all Orders issued. All submissions and/or correspondence received from active participants or the general public relating to the Application will be placed on the public record and posted to the Commissions web site.
