Kelsey, Commissioner P.E. Vivian, Commissioner October 26, 2007 O R D E R WHEREAS: A. The Commission, by Letter No. L-47-06 dated August 25, 2006, advised Unocal Canada Limited (“Unocal”) that it had concluded that Unocal, as owner and/or operator of the Aitken Creek Storage Facility, falls within the definition of a public utility under the Utilities Commission Act (the Act”); and B. By a submission dated October 24, 2006, Unocal applied to the Commission, pursuant to Section 88(3) of the Act, for an order exempting it from all provisions of the Act; and C. On May 14, 2007 the Commission issued its Reasons for Decision on the Unocal application for an exemption; and D. On October 4, 2007, the British Columbia Public Interest Advocacy Centre on behalf of the B.C. Old Age Pensioners Organization et al. (“BCOAPO”), applied for a Participant Assistance/Cost Award (“PACA”) for its participation in the proceeding to review the Unocal application for an exemption (the Proceeding”); and E. By letter dated October 15, 2007, Unocal stated that it has no objections to the BCOAPO application for PACA funding; and . . ./2

The Commission Panel has reviewed the PACA application with regard to the criteria and rates set out in the Guidelines in Commission Order No. G-15-04 and has concluded that a cost award should be approved for BCOAPO in the Proceeding. NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 118(1) of the Utilities Commission Act, the Commission awards funds to BCOAPO for its participation in the Proceeding in the amount of $17,933.03. 2. Unocal is directed to reimburse BCOAPO for the total amount awarded in a timely manner.
