British Columbia Hydro and Power Authority (“BC Hydro”) filed an Application (the “Application”) dated October 3, 2008, with the British Columbia Utilities Commission (the “Commission”), pursuant to sections 58 to 61 of the Utilities Commission Act (“UCA”), for approval to increase the Rate Schedule 1289 ‐ Net Metering Service (“RS 1289”) energy price; and B. RS 1289 was originally approved by Commission Order G‐26‐04 on March 10, 2004. RS 1289 is available upon Application, to customers taking service from BC Hydro who install a generating facility, with a nameplate rating of not more than 50 kW and which can be defined as producing “B.C. Clean Electricity”, to serve their electricity requirements; and C. Customers who generate more energy than they consume, receive a credit from BC Hydro valued at the rate applicable to their electricity service account, which is applied against future consumption charges. At each annual anniversary date, if there is any excess energy remaining in the customer's account, BC Hydro credits the customer for that energy, currently at 5.40 cents/kWh; and D. BC Hydro notes that the Application is consistent with Policy Action No. 11 of the 2007 B.C. Energy Plan, which intends that the price paid for net annual surpluses of generation purchased by BC Hydro be generally consistent with the prices paid under BC Hydro's Standing Offer Program (“SOP”); and E. BC Hydro proposes to increase the RS 1289 energy price from 5.40 cents/kWh to 8.16 cents/kWh. The proposed price of 8.16 cents is the 2006 SOP levelised base price of 7.84 cents, adjusted for inflation; and F. BC Hydro proposes that the Application be reviewed by a written hearing process. …/2

The Regulatory Timetable will be as described in Appendix “A” to this Order. 2. The process will include one round of Information Requests from the Commission and written submissions from Registered Intervenors. 3. BC Hydro is to provide a copy of the Application, and this Commission Order and Regulatory Timetable, to all current RS 1289 customers and to those who were Intervenors in the 2003 RS 1289 proceeding. 4. Those wishing to participate in BC Hydro’s Net Metering Re‐Pricing Application are to advise the Commission Secretary of their intention to do so, in writing no later than Friday, November 7, 2008.
