Contracts under the Residential/Commercial Unbundling Program BEFORE: L.F. Kelsey, Commissioner August 12, 2008 O R D E R WHEREAS: A. On August 11, 2008 Energy Savings B.C. (“Energy Savings”) applied to the BC Utilities Commission (“Commission”) for approval to complete the transfer and assignment of all CEG Energy Options Inc. (“CEG”) residential and commercial gas service Consumer Agreements to Energy Savings; and B. Article 28 of the Code of Conduct for Gas Marketers, Transfer of Agreements requires that the assignment, sale or transfer of a Gas Marketer’s Consumer Agreements to another Gas Marketer must be approved in advance by the Commission; and C. Commission Order A‐27‐07 dated October 29, 2007 approved a Residential/Commercial Gas Marketer Licence for Energy Savings; and D. Commission Order A‐22‐07 dated October 19, 2007 approved a Residential/Commercial Gas Marketer Licence for CEG; and E. After the assignment of the Consumer Agreements takes place from CEG to Energy Savings, CEG will have no further obligation thereunder, and the gas supply arrangements will be assumed by Energy Savings; and F. On August 12, 2008 Energy Savings provided additional information on the current supply of gas to CEG customers for the assignment of Consumer Agreements from CEG to Energy Savings; and G. The Commission finds that the transfer of CEG’s Consumer Agreements to Energy Savings is in the public interest. NOW THEREFORE pursuant to section 71.1(6) of the Utilities Commission Act the Commission orders as follows: . . ./2
BRIT ISH COLUMBIA UTIL IT IES COMMISSION ORDER NUMBER A‐8‐08 2 1. Energy Savings is permitted to acquire the residential and commercial natural gas Consumer Agreements of CEG. 2. The approval granted by the Commission will terminate six months from the date of this Order should the transfer and assignment of all CEG’s residential and commercial gas service Consumer Agreements to Energy Savings be incomplete. 3. Within 30 days of the transfer Energy Savings is to send a letter to all affected residential and commercial Consumers confirming that Energy Savings will be their Gas Marketer. The correspondence must provide the Consumer with all of Energy Savings’ up to date contact information.
