Vivian, Commissioner A.A. Rhodes, Commissioner November 14, 2008 O R D E R WHEREAS: A. British Columbia Hydro and Power Authority (“BC Hydro”) filed an Application (the “Application”), dated October 3, 2008, with the British Columbia Utilities Commission (the “Commission”), pursuant to sections 58 to 61 of the Utilities Commission Act (“UCA”), for approval to increase the Rate Schedule 1289 ‐ Net Metering Service (“RS 1289”) energy price; and B. Order G‐158‐08 established a written process for reviewing the Application and a timetable that included Commission Information Requests and written submissions by Intervenors and BC Hydro; and C. By letter dated November 7, 2008, the BC Sustainable Energy Association and the Sierra Club of British Columbia (collectively “BCSEA”) noted that the regulatory schedule established by Order G‐158‐08 did not provide a deadline for Intervenor Information Requests, and that the BCSEA had sent a set of Information Requests to BC Hydro and asked BC Hydro to respond on a best efforts basis, ideally in conjunction with BC Hydro’s responses to the Commission Information Requests by November 20, 2008; and D. By letter dated November 9, 2008, the Energy Solutions for Vancouver Island Society (“ESVI”), Okanagan Environmental Industry Alliance (“OEIA”) and IslandTransformations.org (“ITO”), (collectively “ESVI, OEIA & ITO”), requested that the timetable be amended by adding an allowance for Intervenor Information Requests with a deadline of November 19, 2008 and that the remaining schedule be shifted accordingly; and E. In a letter dated November 13, 2008 BC Hydro stated that it has no objection to responding to Intervenor Information Requests that are relevant to the Application on a best efforts basis within the existing timetable, nor does it object to the Commission issuing an updated timetable if it so wishes to allow for Intervenor Information Requests; and …/2

The Commission has considered the ESVI, OEIA & ITO request and the letters from BCSEA and BC Hydro, and has determined that amending the timetable is in the public interest. NOW THEREFORE, the Commission, by this Order, determines that the Regulatory Timetable for the review of the Application is amended as shown in Appendix “A” to this Order.
