Vivian, Commissioner O R D E R WHEREAS: A. By Order G‐73‐08 dated April 22, 2008, the British Columbia Utilities Commission (“the Commission”) approved for the Insurance Corporation of British Columbia (“ICBC”) a Negotiated Settlement Agreement dated February 20, 2008 with respect to the Regional Claim Centres Allocation; and B. Order G‐73‐08 and its Reasons for Decision included a direction for ICBC to prepare and file an application for approval of a Proposal Plan for the identification and selection of an independent third party (“ITP”) to review, report on and make recommendations with respect to ICBC’s financial allocation methodology. The Proposal Plan should address proponent qualification criteria, the detailed scope of work required including a review of the Work Effort Study, and the time frame for the review. The Proposal Plan application was to be filed with the Commission no later than October 31, 2008; and C. On October 31, 2008 ICBC filed its Proposal Plan for an Independent Third Party (“ITP”) Review (“the Filing”); and D. The Filing outlines the objectives and scope of the ITP Review. ICBC suggests a process for finalizing the Terms of Reference in which ICBC would meet with the Commission and interested intervenors to obtain feedback on the Terms of Reference prior to the Commission issuing a decision with respect to the Filing. BRIT ISH COLUMBIA UTIL IT IES COMMISSION ORDER NUMBER G‐167‐08 2 E. On November 7, 2008 the Insurance Bureau of Canada (“IBC”) submitted a letter of comment to the Commission. The letter states that IBC is prepared to attend a working session regarding the Terms of Reference. However, IBC is concerned that both ICBC’s letter of October 31, 2008 and the draft Terms of Reference attached to the letter do not properly reflect Order G‐73‐08 and its attached Reasons for Decision. IBC states that any working session will need to begin by first determining the proper scope of the review, report and recommendations before developing the Terms of Reference. IBC notes that it may be appropriate that the Commission ask ICBC to provide a letter and draft Terms of Reference that better reflect the Commission’s direction in Order G‐73‐08; and F. The Commission has reviewed the Filing and letter of comment and considers that the establishment of a Regulatory Timetable is warranted. NOW THEREFORE the Commission orders as follows: 1. ICBC is to hold a Workshop with respect to the Proposal Plan for an Independent Third Party Review of ICBC’s financial allocation methodology, commencing at 9:00 a.m. Tuesday, December 9, 2008, in the Commission’s Hearing Room on the 12 th Floor, 1125 Howe Street, Vancouver, BC. A Regulatory Timetable is attached as Appendix A to this Order. 2. The deadlines for Intervenor Submissions and ICBC Reply Submission on the Filing are set out in the Regulatory Timetable. 3. ICBC is to provide a copy of this Commission Order and Regulatory Timetable to all parties who participated in the 2008 Negotiated Settlement Agreement with respect to the Regional Claim Centres Allocation and those who participated in other ICBC regulatory proceedings during the past year. 4. Intervenors and Interested Parties should register with the Commission, in writing or electronic submission, by Tuesday, December 2, 2008, and advise whether they intend to attend the Workshop.
