Section 5(4) of the Utilities Commission Act (the “Act”) states, in part, “The commission, in accordance with subsection (5), must conduct an inquiry to make determinations with respect to British Columbia’s infrastructure and capacity needs for electricity transmission for the period ending 20 years after the day the inquiry begins or, if the terms of reference given under subsection (6) specify a different period, for that period”; and B. British Columbia Transmission Corporation (“BCTC”) filed its Application for a deferral account for Section5 Inquiry costs on December 16, 2008; and C. The British Columbia Utilities Commission (“Commission”) has considered the BCTC Application. NOW THEREFORE pursuant to section 60 of the Act and section 6 of Special Direction No. 9, the Commission approves BCTC’s Section 5 Deferral Account as described in the Application, effective January 1, 2009.
