Anderson, Commissioner A.A. Rhodes, Commissioner O R D E R WHEREAS: A. On June 27, 2008, Terasen Gas Inc., Terasen Gas (Vancouver Island) Inc. and Terasen Gas (Whistler) Inc. (collectively “Terasen” or “the Companies”) jointly filed a consolidated 2008 Resource Plan (“Resource Plan”) for acceptance by the British Columbia Utilities Commission (“Commission”) in accordance with Section 44.1 of the Utilities Commission Act; and B. On May 28, 2008, Terasen Gas Inc. and Terasen Gas (Vancouver Island) Inc. (collectively “TGI and TGVI”) filed an Energy Efficiency and Conservation Programs Application (“EEC Application”); and C. The Resource Plan includes five‐year capital plans and statements of facilities expansion, although the Companies note that they are not requesting approval of these capital plans; and D. By Order G‐120‐08 the Commission established a written proceeding to review the Resource Plan; and E. The Commission Panel issued Order G‐194‐08 and Reasons for Decision dated December 15, 2008 accepting the 2008 Resource Plan for filing, subject to the comments in the Reasons for Decision attached as Appendix A to the Order. F. By letter dated November 20, 2008, the British Columbia Public Interest Advocacy Centre, on behalf of its clients, the BC Old Age Pensioners Organization et al. By letter dated December 11, 2008, Terasen advised the Commission that it found the BCOAPO application for a cost award reasonable; and H. The Commission has reviewed the application for cost award with regard to the criteria and rates set out in Order G‐72‐07. NOW THEREFORE pursuant to Section 118(1) of the Utilities Commission Act, the Commission awards funds to BCOAPO in the amount of $5,936.88 with respect to its participation in the proceeding. Terasen is to reimburse the British Columbia Public Interest Advocacy Centre, on behalf of its client, for the amount awarded in a timely manner.
