On March 14, 2009 the Commission issued a letter to BC Hydro informing it of the complaint and requesting the following information be provided to the Commission by May 28, 2009: A description of its legal council’s interpretation of the definition of ‘public highways, streets, and lanes, and why pathways and bikeways are not included under this description; and Analysis of its tariff classification for pathway and bikeway lighting in cities of similar size; and Comments on the appropriateness of developing a separate rate class for pathway and bikeway lighting. On March 14, 2009 the Commission issued a letter to the City confirming receipt of the complaint and requesting the following information be provided to the Commission by May 29, 2009: An estimate of the total annual consumption for the lighting in dispute along with a monthly breakdown if available; and The effective date for the proposed tariff reclassification. On June 2 and June 5, 2009 the City and BC Hydro respectively responded to the Commission’s March 14, 2009 letter. On June 18, 2009 the City filed its reply arguments with the Commission. …/2
LETTER NO. L‐54‐09 2 Based on the submissions received, the Commission has determined that BC Hydro has applied its tariffs appropriately in reclassifying the City’s pathway and bikeway lighting from Tariff 1702 to Tariff 1220; however, the Commission requests that BC Hydro evaluate the implications of revising the wording of Tariff 1702 to include bikeway and walkway lighting and report back to the Commission, no later than January 22, 2010, on its findings and conclusions.
