Kelsey, Commissioner P.E. Vivian, Commissioner CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On February 27, 2009 the British Columbia Utilities Commission (the “Commission”) approved the FortisBC Inc. (“FortisBC”) 2009‐2010 Capital Expenditure Plan (the “CEP”), as amended per Order G‐11‐09,and in accordance with said Order on July 20, 2009 FortisBC applied (the “Application”) to the Commission, pursuant to section 45 of the Utilities Commission Act (“the Act”), for a Certificate of Public Convenience and Necessity (“CPCN”) for an Upgrade and Life Extension to its Corra Linn Unit 2 generating plant located on the Kootenay River between Castlegar and Nelson, B.C. (the “Project”); and B. The Project is estimated to cost $19.964 million (reduced from $22.681 million as specified in the CEP) and will replace 77 year old components that will extend the plant’s life for a further 40 years and increase the utility system’s reliability and available energy entitlements as provided for in the Canal Plant Agreement; and C. The Project includes upgrades to the Corra Linn Power House Crane and East Wingdam Handrail, and completion of the Corra Linn Spillway Gate Isolation Study; and D. The Project is supportive of the Province’s energy objectives including those relating to energy self‐ sufficiency; and E. A duly noticed Workshop related to the Project was held in Kelowna, B.C. on August 12, 2008, with no objections being made or received since; and G. The Application is unopposed; and H. The Commission has considered the Application evidence and submissions of FortisBC; and I. The Commission has considered the Application and has determined that the Project is in the public interest and that a CPCN should be issued to FortisBC for the Corra Linn Unit 2 Project. NOW THEREFORE pursuant to sections 45 and 46 of the Act, the Commission orders as follows: 1. A CPCN is granted to FortisBC to proceed with an Upgrade and Life Extension to the Corra Linn Unit 2 generating plant as set out in the Application. 2. FortisBC is to file with the Commission quarterly project progress reports and a closing project report and cost summary within three months of Project completion.
